2023 State Long-Term Care Ombudsman Annual Report | Now Available. The Tennessee Office of the State Long-Term Care Ombudsman advocates for Tennesseans residing in long-term care facilities, including nursing homes, assisted care living facilities, homes for the aged and adult care homes. LeadingAge, Fellow Plaintiffs File Motion for Summary Judgment in Staffing Standard Lawsuit. On October 18, LeadingAge and our fellow plaintiffs in the lawsuit challenging the CMS nursing home staffing final rule filed a motion for summary judgment, along with a supporting memorandum of law, asking the court to grant judgment in our favor on our claims that the staffing requirements must invalidated. The motion argues that the staffing requirements must be set aside because they exceed CMS’ statutory authority and because the rule is arbitrary and capricious. “CMS has not even tried to claim that the statutory provisions in which Congress explicitly addressed staffing requirements empower the agency to enact these sweeping new mandates,” the memorandum argues. Life Safety Updates from HITF for Nursing Homes. At its latest meeting, the Healthcare Interpretations Task Force (HITF), a coalition of leading organizations instrumental in shaping fire protection policies for the healthcare sector, reviewed interpretations of the Life Safety Code. This summary highlights key issues pertinent to long-term care providers. These revisions are essential for ensuring compliance with current standards and enhancing the overall safety of nursing home residents and staff. Providers are encouraged to review the latest interpretations and implement necessary changes to their facilities.

The laws that govern Life Plan Communities (LPCs) – referred to as continuing care retirement communities (CCRCs) in statute - vary widely by state and have a significant impact on the financial success and long-term sustainability of LeadingAge members. A new, in-depth resource from LeadingAge’s Dee Pekruhn, Director, LPC Services and Policy, provides insights into the evolving statutory landscape of LPC/ CCRCs’ contract language. This Learning Hub resource – the first in a series of six that will offer deep dives into the issues most important to LPCs – is a comprehensive comparison of four core components of statutorily-required contract language: how a “CCRC” is defined, state-required disclaimer statements, transitions to higher levels of care, and contract termination. CARF, Ziegler, Baker Tilly: 2023 CCRC Financial Ratios Analysis Released. The annually-compiled, 2023 CCRC Financial Ratios and Trend Analysis was released on October 18. The analysis is a collaborative effort between CARF, Ziegler and Baker Tilley that reviews CARF-accredited CCRCs’ financial performance for the prior fiscal year. Overall, a Ziegler article releasing the report summarized two key points: that SSO CCRCs’ operational and financial performance had stabilized over the course of 2023, and MSO CCRCs saw a “bonafide improvements” over the same period.
